A Power of Attorney is a legal document giving authority for someone else to make decisions, including financial on your behalf.
A Power of Attorney can be made effective immediately or at a future date, which can be useful if you’re overseas, become unwell or face mental incapacitation.
We strongly recommend seeking legal advice promptly when considering the creation of a Power of Attorney, as there are different types of variations to consider, each with their own implications.
At Greenline Legal, our expert team is ready to guide you through the process of establishing a Power of Attorney. We aim to provide comprehensive advice tailored to your circumstances.
Our Process
1. Meet with us
We will meet with you at a time and place that is convenient for you. We will discuss details concerning your needs, who you would like to appoint and when and what circumstances you would like your Power of Attorney to become active.
2. Review Your Information
We will review information supplied by you. We may also need some paperwork to confirm the information you provide to us. We will consider the law that applies to your particular circumstances and wishes and determine whether there will be any issues in drafting your Power of Attorney as you would like it.
3. Commence Drafting Your Power of Attorney
We will commence drafting your Power of Attorney and ensure that it is “air tight” to protect as best as possible against any disputes arising from friends, family members, financial service and medical treatment providers.
4. Witnessing and Signing Your Power of Attorney
We will explain the contents of your Power of Attorney and make sure they are correct and you are happy with the document. We will then arrange for you to sign the document and have your appointees also accept their appointment in the document.
5. Storage and Advice
We will be happy to store your original Power of Attorney for safe keeping if you would like us to. We will provide you with a copy for your records. We will also provide you with a letter confirming that the work is completed. It is important to let family members and friends know where your original Power of Attorney is held.
